In Rwanda, as everywhere else, the judicial process has several stages, sometimes quite long. In order for justice to be done, it is necessary that the judgment cast in res judicata be executed in favor of the winning party by the losing party.This way of doing things voluntarily is hampered by the poor culture of disrespect between the parties to the lawsuits or the contractors. When the decisions of the courts and other enforceable titles are not voluntarily put into execution, then the Bailiffs are resorted to proceed to enforcement. Bailiffs are of two categories:
1. Professional bailiffs;
2. Non-professional bailiffs.                                                  
As the name indicates, the professional bailiff is any person to whom the law gives the power to execute the decisions of the courts and other enforceable titles bearing the executory formula, and to pause other acts of his competence in a professional manner.While the non-professional bailiff is any agent of the State, which beside his functions, is judicial officer by the law during the time of his functions. The Professional Bailiffs are members of the Professional Bailiffs Association, which coordinates their activities and disciplines.Non-professional bailiffs are coordinated by the institutions for which they work. In order to strengthen their capacity through training and regular meetings, both Professional Bailiffs and non-professionals are supported by the Ministry of justice in its attributions and other partners.The professional bailiffs' fees are provided for by the Ministerial Decree.
The organs of the Professional Bailiffs Association, their functioning and their complementarity are provided by Law N ° 12/2013 of 22/03/2013 bearing the function of the Bailiffs published in the Official Journal N ° 14 of 08 April 2013.
